It sounds like poor engineering and construction to me. Now Virgin knows what it feels like to have people cut corners and save money.

Nothing better than a lovely bit of tort. I would be surprised if this doesnt get settled before it gets to court tbh. Although VS maybe on a mission to bring the case.
