Saw this one on Air Crash Investigation the other week. Scary. But didnt quite get how the company putting the wrong piece of equipement on the aircraft was the fault of the pilots?

There are other checks which should have alerted them to the shortfall in loaded fuel, they should not have relied on the read out of a single instrument.

Pilot assumed aircraft had been refuelled after fuel gauge replaced, despite not having the paperwork (which was a requirement!).
If he had properly demanded the paperwork before takeoff, the error would have been discovered.

It has also been demonstrated (in simulators!) that they had sufficient altitude to glide to airport - if they had trimmed for best glideslope - instead they attempted numerous engine restarts and did not feather the props.

That may be the reasoning of the judiciary who typically have to find someone to blame....unlikely anyone will actually serve time.
