I am sure one of my learned Vflyers will know.

My son si due to fly LGW-CLT-RSW with US air today . the 10am departure has been delayed to at least 2pm as the plane has gone tech.

so, what are his legal rights for delays up to and then over 4 hours. do they have to feed and water him to any level.

he will definitely miss his planned connection to RSW but might just get the last one to SRQ. If not , again what are his rights regards accomodation ?

With regard to the LGW-CLT sector, the airline has to provide:

- Food & drink in relation to the length of delay
- 2 phone calls / emails / faxes
- Overnight accommodation if required.

Did your son book the whole ticket with US Airways, and is the onward connection from CLT-RSW operated by US as well? If so, I believe they are responsible for booking him onto the next available connection and again, providing overnight accommodation if required.

This is what the EU 261/2004 says.

Under that your son won't get anything until 4 hours have past (due to the length of the flight) when they are required to provide the things MrSquare lists. There is no compensation payable for delays (though there are a number of court cases pending on that)

Not sure about the onward intra USA flight though but I'd expect US to re-arrange connections. The EU rights will cease to apply once he arrives in the USA and any USA regulations will take over.

thansk guys, well some 5 hours later it has been cancelled. the plane had hydraulic problems apparently. we are now waiting to see what happens tomorrow. its not the biggest hassle, he loses a day of his hols, the annoying bit is we had tickets to tomorrows Tampa v Carolina NFL game, which we will now miss :-(

Now that is something to be upset about! Went to see The Buccs a couple of years back and it was awesome!! Hope all turns out well in the end :)

just to update. USAir seemed to perform fairly well. the flight was cancelled around 5pm. apparently the UK end knew there was no chance but HO said keep trying. pity as they might have got my lad on the late VS flight.
anyway those who wanted accomodation (about 60 odd) were put in the Hilton. they were given phone cards free evening meal and brekkie.
he was told an agent would be down mid evening or he could call a toll free number, which i told him to do and be polite and say 'well i can go straight to florida with virgin if it helps !! :-)"

apparently some pax (mainly Americans had got quite belligerent at the original (Non USAir) staff at the airport, to the extent one was photographing them ' so they could be identified when he sued " ! this wasnt going down to well.

anyhow, when he rang they first tried to send him to Chicago from LHR late last night with a layover at Ohare. he didnt fancy that and they wouldnt get him to LHR so he declined. she then said "ok you can go as planned on tomorrows flight....oh no you cant its over booked!"................so right now he is winging his way to MCO on the 11.20 BA flight

so all in all it seems US handled it the best they could
